Public Punishment Suspended for Drunken Driver

Filed under: DWI/DUI/Alcohol — Law Offices of Billy Skinner @ 1:52 pm

39-year-old Michael Giacona spent 90 days in jail after a drunk driving incident that killed a 20-year-old victim last summer.

Along with his jail time, the judge also sentenced him to wear a sign for four consecutive Saturdays reading, “I killed Aaron Pennywell While Driving Drunk.”

During the first weekend of his public sentence, passers-by became hostile towards Giacona.

The judge has relieved Giacona of his public sentence for his safety while he re-evaluates the sentence and finalize a decision on Wednesday.

Despite Giacona’s absense, friends and family of the victim gathered at the site of the incident with their own signs warning people of the dangers of drunk driving.

A Corpus Christi woman was arrested Saturday morning after sending police on a low speed chase.

Reacting to a complaint about a suspicious person, police found Taylor Burnham wearing nothing but cowboy boots standing between a Jeep Wrangler and somebody’s back fence.

Upon seeing the police, Burnham jumped in the wrangler and lead the police on a chase that never exceeded 30mph.  The chase only lasted around a mile and a half but Burnham did manage to drive on the sidewalk at one point.

Once the suspect was apprehended, a female police officer arrived on the scene to clothe the suspect.  She was then given a barrage of sobriety tests which she did not pass.

Burnham was arrested for both evading arrest and driving while intoxicated.

The incident started around 2:20am at Hempstead Hwy near Dacoma.

Police say that the man was in some sort of altercation with another at the bar when he got in his truck to leave.  He ran over somebody in the parking lot while leaving the establishment.  The person struck was transported to a hospital and is in stable condition.

Houston is 25th Drunkest City in America

In this case, being number 25 is probably better than being number 1. In light of this news about Houston’s place among drinking cities, and the super drinking day, New Year’s Eve tomorrow, this is an apt time to remind everyone to NOT drink and drive. Appoint a designated driver, call a cab or take advantage of the cities Metro free ride home program.

Whatever you do, don’t drink and drive!  A DWI arrest is much more expensive than a cab ride home.

If you do find yourself a little too close to the long arm of the law, and you need a DWI attorney in Houston, call my office for a free consultation 713-600-7777. I’ll fight your case.

156 drivers charged with intoxication offenses over Christmas weekend

Filed under: DWI/DUI/Alcohol — Law Offices of Billy Skinner @ 6:38 pm

District Attorney Pat Lykos announced Wednesday that one hundred and fifty-six drivers were charged with intoxication offenses between December 23 and December 26.

Forty one percent of the people arrested showed a blood alcohol concentration (BAC) of more than 0.15.  Of the one hundred and fifty six drivers, two of them caused serious bodily injury to others.

Because of Harris County’s No Refusal Program, and Texas DPS’s recent supervision of the county’s breathalyzers, police were able to take the drivers to the nearest breathalyzer facility, regardless of which agency owned the equipment.

Lykos said that this year is lower than the previous for intoxication accidents.

Drivers are advised to coordinate safe transportation over the New Year holiday weekend as the program will continue to be in effect.

DWI Houston News

Virtually everytime I meet someone charged with driving while intoxicated some part of our discussion centers around the “science” of alcohol consumption and how consumption relates to the blood alcohol tested by Police. Whether a client voluntarily took a breath test or was forced to submit to a blood tests, clients are always very interested in how alcohol interacts with their body. I found this article in the Wall Street Journal to be both informative and interesting for the curious person who drinks. Is this pure science, no, but this article does illustrate how alcohol impacts each person differently. The bottom line remains the same. If you are pulled over in Houston and you so much as have the odor of alcohol on your breath you are more than likely going to be arrested for DWI.

If you are arrested for DWI you need an attorney that will fight for your rights, give you sound advice and help you continue on with your life. Call our office today for a free consultation. 713-600-7777

Houston “Crime” News

Filed under: DWI/DUI/Alcohol,General Criminal Law — Billy @ 9:56 pm

Over the past few days the Harris County District Attorney’s Office and the Houston Police Department have been all over the news, and not for the reasons they wish. In one case where children died in a daycare fire, the DA and the Houston Fire Department are waging a war over which office screwed up. On another front, they had to admit a man had been wrongfully sent to prison for 17 years. And then there was the story about how HPD is wasting taxpayers money on a DWI enforcement program. What all this means is that people are very often WRONGFULLY ACCUSED of crimes in Houston. If you have been accused of committing a crime you need an attorney that understands the system and will fight your case. Call our office today and find out how we can help you.

I will preserve your innocence and protect your Constitutional rights... As your Criminal Defense Attorney, I will FIGHT your case!
