Section 481.002 of the Texas Health and Safety Code defines marijuana as any part of the cannabis plant, including viable seeds, leaves, any compound, salt mixture, derivative, or preparation of cannabis seeds or leaves. Actual vs. Constructive Possession of Marijuana in Houston

- Possession of two ounces or less is a Class B misdemeanor, punishable by up to 180 days jail and up to a $2,000 fine.
- Possession of more than two ounces but less than four ounces is a Class A misdemeanor, punishable by up to a year in jail and up to a $4,000 fine.
- Possession of more than four ounces but not more than five pounds is a third degree felony, punishable by two to ten years in prison and a fine of up to $10,000.
- Possession of more than 50 pounds but not more than 2,000 pounds is a second degree felony, punishable by two to twenty years in prison and a fine of up to $10,000.
- Possession of more than 2,000 pounds of marijuana is a first degree felony, with a punishment of life in prison or a sentence of 5-99 years in prison and a fine of up to $50,000.
